Terms of Service — Meow

1. Agreement to Terms

By downloading, installing, or using the Meow application (“App”, “we”, “us”, “our”), you agree to be bound by these Terms of Service (“Terms”). If you do not agree to these Terms, do not use the App.

These Terms constitute a binding legal agreement between you (“User”, “you”) and the developers and publishers of Meow. Your use of the App indicates your acceptance of these Terms in their entirety.

2. Description of Service

Meow is a privacy-focused Telegram client that encrypts messages, photos, videos, and documents using application-level encryption (AES-256) with a user-defined shared encryption key before transmission to Telegram’s servers. Meow operates on a single-chat configuration and does not support multi-chat functionality.

The App is provided for personal communication purposes between authorized users only. Meow does not host, store, or manage encrypted content — Telegram does. Meow merely provides an encryption layer on top of Telegram’s infrastructure.

3. Prohibited Uses

YOU EXPRESSLY AGREE NOT TO USE THE APP FOR ANY OF THE FOLLOWING PURPOSES:

3.1 Illegal Activities

Any use that violates local, national, or international laws or regulations.
Use of the App in furtherance of any crime, fraud, theft, or other unlawful conduct.
Circumventing legal surveillance, court-ordered monitoring, or law enforcement investigations.

3.2 Coercion and Abuse

Using the App to harass, intimidate, threaten, blackmail, or coerce any person.
Sending threats, hate messages, or content intended to cause emotional or psychological harm.

3.3 Unauthorized Access

Attempting to gain unauthorized access to the App’s systems, TDLib, Telegram, or other infrastructure.
Reverse-engineering, decompiling, or attempting to extract the encryption key or proprietary code.
Sharing the shared encryption key with unauthorized parties or allowing unauthorized access.

3.4 Intellectual Property and Content Abuse

Uploading, transmitting, or distributing copyrighted, trademarked, or proprietary content without authorization.
Distributing sexually explicit material, child sexual abuse material (CSAM), or illegal content.
Distributing malware, viruses, spyware, or other malicious code.

3.5 Impersonation and Fraud

Impersonating any person, entity, or government agency.
Making false claims about the App’s capabilities, security, or legality.
Fraudulently soliciting money, information, or access from other users.

3.6 Circumvention of Laws and Regulations

Using the App to evade or circumvent court orders, subpoenas, or lawful government requests.
Violating export control laws or sanctions regulations.
Using the App for human trafficking, organ trafficking, or other forms of trafficking.

4. User Responsibility and Compliance

4.1 Sole Responsibility

You assume sole and exclusive responsibility for:

Your use of the App and all communications transmitted through it.
Ensuring your use complies with all applicable laws, regulations, and third-party rights.
Verifying that you have legal authority to communicate the content you send.
Obtaining all necessary consents from third parties before transmitting their communications, images, or data.

4.2 No Warranty of Legality

We do not warrant, represent, or guarantee that your use of the App is legal in your jurisdiction. You are solely responsible for determining whether use of the App complies with the laws of your country, state, province, or other applicable jurisdictions.

4.3 Compliance with Telegram Terms

Your use of the App is also subject to Telegram’s Terms of Service and Privacy Policy. Any violation of Telegram’s terms may result in suspension of your Telegram account, which we cannot prevent or reverse.

5. No Warranties and Limitation of Liability

5.1 “As Is” and “As Available” Disclaimer

THE APP IS PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT ANY WARRANTIES, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT.

We make no warranty that:

The App will meet your requirements or expectations.
The App will be uninterrupted, error-free, or secure.
The encryption will be unbreakable or the shared key will remain confidential.
Your data will be protected from unauthorized access or loss.
The App complies with the laws of your jurisdiction.

5.2 Complete Disclaimer of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, WE EXPRESSLY AND COMPLETELY DISCLAIM LIABILITY FOR ANY AND ALL DAMAGES, WHETHER DIRECT, INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, PUNITIVE, OR EXEMPLARY, ARISING FROM OR RELATED TO:

Your use or inability to use the App.
Your misuse or improper use of the App.
Any loss, interception, or compromise of the shared encryption key due to your actions or negligence.
Unauthorized access to encrypted content by third parties due to your failure to protect the shared key.
Any data breach, loss of data, or corruption of data.
Any unlawful activity conducted through the App by you or any other user.
Any harm to third parties caused by your use of the App, including but not limited to unauthorized surveillance, privacy violations, or transmission of illegal content.
Any defamation, slander, libel, or offensive content transmitted through the App.
Any loss of privacy, reputation, or personal security of any person.
Suspension or termination of your Telegram account.
Any interruption, delay, or unavailability of the App or Telegram’s services.

This disclaimer applies even if we have been advised of the possibility of such damages.

5.3 Limitation of Liability

In no event shall our total liability to you exceed one dollar (USD $1.00) or the equivalent in your local currency, regardless of the cause of action, whether in contract, tort, negligence, strict liability, or any other legal theory.

Some jurisdictions do not allow the exclusion or limitation of liability for consequential or incidental damages. In such jurisdictions, our liability shall be limited to the maximum extent permitted by law.

6. Indemnification

You agree to indemnify, defend, and hold harmless the developers, publishers, and distributors of Meow, as well as all related entities, from and against any and all claims, damages, losses, liabilities, costs, and expenses (including attorneys’ fees) arising from or related to:

Your use or misuse of the App.
Your violation of these Terms or any applicable law or regulation.
Your violation of the rights of any third party.
Any unlawful, fraudulent, or criminal activity conducted by you through the App.
Your failure to protect or properly manage the shared encryption key.
Any harm to third parties caused by your conduct.

7. No Monitoring or Enforcement

We do not actively monitor, police, or enforce compliance with these Terms. However, we reserve the right to investigate and take action against users we believe have violated these Terms, at our discretion, at any time.

We are not obligated to monitor user activity, and the absence of enforcement against any user for violating these Terms does not constitute a waiver of our rights or a grant of permission to violate these Terms.

9. No Obligation to Assist Law Enforcement

While we respect legitimate law enforcement requests, we cannot decrypt, recover, or assist in accessing content encrypted by users. All encrypted content is encrypted on the user’s device using their shared key, which we do not possess, store, or have access to. Any law enforcement inquiries should be directed to Telegram.

10. Third-Party Services and Links

The App integrates with Telegram’s servers through TDLib. We are not responsible for Telegram’s policies, practices, or any harm resulting from your use of Telegram. Your use of Telegram is governed by Telegram’s own Terms of Service and Privacy Policy.

We are not responsible for any third-party services, content, or websites that may be accessed through the App.

11. Governing Law and Jurisdiction

These Terms shall be governed by and construed in accordance with the laws of the Republic of Peru, without regard to its conflict of law principles.

Any legal proceeding or dispute arising under or related to these Terms shall be brought exclusively in the courts of Arequipa, Peru, and you agree to submit to the personal jurisdiction of such courts.

If you are located outside Peru, you consent to the exclusive jurisdiction and venue of the courts in Arequipa, Peru.

12. Entire Agreement

These Terms, together with the Privacy Policy and any other policies referenced herein, constitute the entire agreement between you and us regarding your use of the App and supersede all prior agreements, understandings, and negotiations.

13. Changes to These Terms

We reserve the right to modify these Terms at any time. Changes will be effective upon posting to this document. Your continued use of the App after changes are posted constitutes your acceptance of the modified Terms.

It is your responsibility to review these Terms periodically for changes. If you do not accept the modified Terms, you must stop using the App.

BY USING THIS APP, YOU ACKNOWLEDGE THAT YOU HAVE READ, UNDERSTOOD, AND AGREE TO BE BOUND BY THESE TERMS OF SERVICE IN THEIR ENTIRETY.

YOU FURTHER ACKNOWLEDGE THAT YOU UNDERSTAND THE RISKS ASSOCIATED WITH USING THE APP AND THAT YOU ARE SOLELY RESPONSIBLE FOR YOUR USE AND ANY CONSEQUENCES ARISING FROM YOUR USE OF THE APP.
