1. Agreement to Terms

By downloading, installing, opening, or using GhostCat (the “App”), you (the “User”) acknowledge that you have read, understood, and expressly agreed to these Terms of Use. If you do not agree with any part of these Terms, you must refrain from installing or using the App and uninstall it immediately.

The App may be used by minors for lawful purposes. In such cases, the parent or legal guardian accepts these Terms on behalf of the minor, assumes all obligations set forth herein, and is responsible for supervising the minor’s use of the App.


2. Nature and Purpose of the App

GhostCat is a mobile application designed for video note recording and quick audiovisual evidence capture using the device’s camera and microphone, for personal, legitimate, and lawful purposes, such as:

  • Recording personal notes in audiovisual format.
  • Documenting facts, incidents, or evidence that the User is authorized to record.
  • Capturing content that belongs to or is voluntarily produced by the User.
  • Professional or academic use when the User holds the appropriate authorizations.

The App does NOT transmit, sync, or send recorded videos to external servers. All files are stored locally on the User’s device.


3. Key Features the User Acknowledges and Accepts

The User expressly acknowledges that the App includes the following technical features and understands their implications:

  1. Simultaneous video and audio recording. All recordings include ambient audio by default, captured through the device’s microphone.
  2. Floating bubble (overlay). The App can display a floating control over other applications when the User enables it and grants the overlay permission.
  3. Background recording with screen off. The App can continue recording while the device is locked or the screen is off, using a partial WakeLock. This is necessary for the declared use case.
  4. Activation via volume buttons. The App can be started or stopped using the device’s physical volume keys.
  5. Persistent recording notification. While recording is active, the Android operating system displays a mandatory notification indicating that the camera and microphone are in use. This notification is a system requirement and cannot be hidden by the App.
  6. Gallery-hidden storage. By default, generated files are hidden from the system gallery using a .nomedia file. The User may change this behavior in the App settings.
  7. Close with recents removal. When stopping a recording, the App may remove itself from the system’s recent apps list.
  8. Local PIN lock. The App allows access protection via a locally stored PIN. This PIN is not a cryptographic security mechanism and should not be used to protect sensitive content against an attacker with physical access to the device.

4. Responsible Use and Prohibited Conduct

The User agrees to use GhostCat exclusively for lawful, ethical purposes and in compliance with applicable law in their country of residence and in any jurisdiction where recordings are made. In particular, the User agrees NOT to use the App for:

4.1 Unauthorized Recording of Third Parties

  • Recording individuals without their prior, free, informed, and express consent where such consent is legally required.
  • Recording private conversations in which the User is not a participant or does not have legal authorization.
  • Conducting covert surveillance of any person, including partners, family members, minors, employees, neighbors, or any other third party.
  • Capturing images or sound in locations where there is a reasonable expectation of privacy (bathrooms, changing rooms, third-party bedrooms, hospitals, etc.).

4.2 Unlawful Conduct

  • Harassment, intimidation, stalking, or cyberbullying.
  • Production, possession, or distribution of material involving minors in a sexual, violent, or degrading manner.
  • Capturing confidential information, trade secrets, protected personal data, or information subject to professional secrecy.
  • Industrial, governmental, military, or national security espionage.
  • Recording within facilities where it is expressly prohibited (military zones, courtrooms, correctional institutions, voting rooms, etc.).
  • Violation of the right to one’s own image, personal and family privacy, honor, or personal data protection.
  • Any conduct classified as a criminal offense under applicable law.

4.3 Unlawful Distribution

  • Publishing, broadcasting, sharing, or commercializing recordings obtained with the App without the consent of the individuals appearing in them, where such consent is legally required.
  • Using recordings for extortion, blackmail, defamation, or any harmful purpose.

The laws governing the recording of images and audio vary substantially across countries, states, and regions. Some jurisdictions require the consent of all parties involved in a recorded conversation (“two-party / all-party consent”); others require only the consent of the recording party (“one-party consent”). Additional regulations may apply regarding:

  • Personal data protection.
  • The right to one’s own image and to privacy.
  • Recordings in employment, educational, healthcare, and judicial settings.
  • Use of recordings as evidence in legal proceedings.

It is the User’s sole responsibility to know, understand, and fully comply with all applicable laws, regulations, and rules in every place and at every time the App is used. The Developer does not provide legal advice, and the App does not perform any automated verification of the legality of use.


When a recording involves persons other than the User, the User agrees to:

  1. Clearly and in advance inform those persons that a recording is ongoing or will take place.
  2. Obtain express consent from each person being recorded, as required by applicable law.
  3. Respect the revocation of consent if the recorded person requests it, deleting the relevant material.
  4. Not alter, edit, or decontextualize recordings in ways that harm third parties.

7. Limitation of Liability and Developer Disclaimer

THE USER EXPRESSLY ACKNOWLEDGES AND AGREES THAT:

  1. The App is a neutral tool that executes only the User’s instructions.
  2. The Developer has no access, control, knowledge, or supervisory capacity over recorded content, as the App operates entirely locally and does not transmit data to external servers.
  3. The Developer is not responsible for:
    • Content captured by the User.
    • The use, distribution, publication, or disposition of recordings by the User.
    • Civil, criminal, administrative, labor, or any other consequences arising from misuse of the App.
    • Damages to third parties caused by the User while using the App.
    • Loss, corruption, or deletion of files stored on the device.
    • Device failures, operating system issues, camera hardware, microphone, or storage failures.
    • Interruptions, software errors, or incompatibilities with specific devices.
  4. The App is provided “AS IS” and “AS AVAILABLE”, without warranties of any kind, express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, or non-infringement.

To the maximum extent permitted by applicable law, the Developer’s total liability to the User for any claim arising from the use of the App is limited to the amount actually paid by the User for the App (which, being free in its current version, is zero).


8. Indemnification

The User agrees to indemnify, defend, and hold harmless the Developer, collaborators, partners, affiliates, legal representatives, and anyone associated with the project, from and against any claims, demands, legal actions, complaints, administrative sanctions, fines, costs, professional fees (including attorney’s fees), or damages of any nature arising from:

a) Misuse, unlawful, or unauthorized use of the App by the User.
b) Violation of these Terms.
c) Violation of third-party rights (including rights to image, privacy, data protection, intellectual property, honor, or any other rights).
d) Breach of any applicable law, regulation, or rule.
e) Third-party claims related to recordings made using the App.

This indemnification obligation survives the uninstallation of the App or the termination of these Terms.


9. System Permissions

To function, the App requires the following Android operating system permissions, which are granted voluntarily and consciously by the User:

  • Camera (CAMERA): for video capture.
  • Microphone (RECORD_AUDIO): for synchronized audio capture.
  • Foreground Service (FOREGROUND_SERVICE, FOREGROUND_SERVICE_CAMERA, FOREGROUND_SERVICE_MICROPHONE): to record while the app is not in the foreground.
  • Overlay over other apps (SYSTEM_ALERT_WINDOW): optional, for the floating bubble.
  • Notifications (POST_NOTIFICATIONS): to display recording status.
  • Wake Lock (WAKE_LOCK): to keep recording active with the screen off.

The User may revoke these permissions at any time from the device settings, which may partially or fully affect the App’s functionality.


10. Data Storage and Deletion

  • All recordings are stored locally on the User’s device, within the directory assigned by the operating system to the App.
  • The Developer has no access to these files.
  • The User is solely responsible for the custody, backup, deletion, and final disposition of generated files.
  • Uninstalling the App may permanently delete files that have not been backed up, depending on the system configuration.

11. Intellectual Property

The software, source code, design, brand, logos, and visual identity of GhostCat are the exclusive property of the Developer and are protected by applicable intellectual property laws. The User receives only a personal, non-transferable, non-exclusive, and revocable license to use the App in accordance with these Terms.

Content recorded by the User is the User’s sole property and responsibility, without prejudice to the rights of third parties that may appear in such content.


12. Modifications to the Terms

The Developer may modify these Terms of Use at any time. Modifications will be communicated through an App update or publication at the official URL. Continued use of the App after a modification constitutes acceptance of the updated Terms of Use.


13. Suspension and Termination

The Developer reserves the right to discontinue the App, in whole or in part, at any time and without prior notice. Termination does not affect the User’s obligations arising from prior use, especially the indemnification obligations (Section 8).


14. Governing Law and Jurisdiction

These Terms are governed by the laws of the Republic of Peru. Any dispute arising from the interpretation, application, or enforcement of these Terms of Use shall be submitted to the competent courts of the city of Arequipa, Peru, with both parties waiving any other jurisdiction that may apply to them.

The foregoing is without prejudice to the mandatory consumer protection rules that may apply to the User in their country of residence.


15. Severability

If any provision of these Terms is declared null, invalid, or unenforceable by a competent authority, that provision shall be deemed severable and shall not affect the validity or enforceability of the remaining provisions, which shall continue in full force and effect.

FINAL USER DECLARATION

BY INSTALLING AND USING GHOSTCAT, THE USER DECLARES UNDER THEIR SOLE RESPONSIBILITY:

  • Having read these Terms in their entirety.
  • Understanding the technical features and legal risks associated with misuse of the App.
  • Committing to use the App exclusively for lawful purposes.
  • Holding the Developer harmless from any claim arising from their use.
  • Complying with all applicable laws regarding image and audio recording, personal data protection, the right to privacy, and the right to one’s own image.

Failure to comply with any of these declarations is the User’s sole responsibility.
